Abstract
1839 yılında Mustafa Reşit Paşa tarafından Gülhane Parkı'nda okunan Tanzimat Fermanı (Gülhane Hatt-ı Hümayunu), Osmanlı Devleti'nde kanunlaşma sürecini başlatmıştır. Bu fermanın bir haklar bildirgesi mi yoksa yalnızca padişahın bir lütfu mu olduğu tartışmalıdır. Bununla birlikte Tanzimat Dönemi, günümüzde uygulanan mevzuatın temelini oluşturan kanunların yapılması ile dikkat çekmektedir. Özellikle 1876 tarihli Kanun-i Esasi, Türk anayasa tarihi açısından büyük öneme sahiptir. Bu çalışmanın amacı, Tanzimat Dönemi süresince Osmanlı Devleti'nde yapılan hukuk reformlarının bir arada incelenmesidir. Her bir düzenleme, olumlu ve olumsuz yönleriyle ele alınmıştır. Önemli görülen maddeler ayrıca irdelenmiştir. Düzenlemelerin öncesindeki tarihsel süreçlere de yer verilmiştir. Çalışmamızın Tanzimat Dönemi araştırmacılarına verimli bir kaynak oluşturacağına inanmaktayız.
The proclamation of the Tanzimat Edict (Gülhane Hatt-ı Hümayunu) by Mustafa Reşit Pasha at Gülhane Park in 1839, had initiated the codification process in the Ottoman Empire. It is argued whether this edict was a declaration of rights or merely a sultan's favor. Nevetheless, the significance of the Tanzimat Period is undeniable as the codes that constitutes the basics of contemporary Turkish law, was first formed in this period. Especially, the Constitution of 1876 has a great importance in terms of Turkish constitutional history. The aim of this study is to examine all the law reforms carried out during the Tanzimat Period in the Ottoman Empire in one aspect. Each regulation has been addressed with both its arguably positive and negative sides. However, some provisions are emphasised more due to their value in discussion. Historical processes before the regulations are also included. We believe that our work will be an efficient source for the researchers of the Tanzimat Period.
