Türkiye'de Yurt Dışı Oy Hesaplamasının Temsilde Adalet İlkesi Çerçevesinde Değerlendirilmesi

Abstract

Modern demokrasinin ilk kurumsallaştığı yıllarda oy hakkı imtiyazlı bir kitleye tanınmışken günümüzde bu hak hiçbir ayrım gözetilmeksizin tüm vatandaşlara tanınmaktadır. Bu anlamda devletlerin yurt dışındaki vatandaşlarına yönelik olarak oy kullanma hakkı tanıma uygulamasının tarihi oldukça yenidir. Bu sebeple oy kullanma hakkı artık ülke sınırlarını da aşan bir düzleme oturmuştur. Hal böyle olunca bu uygulamaların mevcut demokratik standartları olumsuz yönde etkilemesinin aksine, bu standartları daha da yukarıya taşıyacak bir eğilim göstermesi gerekmektedir. Çalışmanın ana problemi de tam olarak bu husus üzerine oturmaktadır. Yani daha açık bir ifadeyle bu çalışmada Türkiye'deki mevcut yurt dışı oy uygulamasının temsilde adalet ilkesini ve temsil ilişkisini ne ölçüde ve ne şekilde etkilediği sorusuna bir cevap aranmaya çalışılmaktadır. Çalışma içerisinde Türkiye'deki yurt dışı oy kullanımının uygulandığı seçimler temsilde adalet ilkesi ve kuramsal temsil ilişkisi çerçevesinde değerlendirilerek, dünyadaki diğer uygulamalar üzerinden önerilerde bulunulmaktadır. While the right to vote was granted to a privileged audience in the years when modern democracy was institutionalized, this right is granted to all citizens without any discrimination. So, the history of the practice of giving the right to vote for the citizens abroad is quite new. For this reason, the right to vote has now settled on a plane that transcends the borders of the country. In this case, contrary to the negative effects of these practices on the existing democratic standards, they should show a tendency to increase these standards even further. The main problem of the study is fully based on this issue. So more precisely the principle of fair representation of the available applications in Turkey and overseas votes in this study represent the relationship of an answer to the question to what extent and in what way is tried to be affected. The study evaluated in the framework of principles of justice and institutional relations representative in the implementation of overseas voting representation elections in Turkey, some suggestions are made out of other applications in the world.
