Abstract
Tarihsel süreç içinde yaşanan olaylar ve özellikle II. Dünya Savaşı'nda meydana gelen yıkımlar hem devletler açısından, hem de uluslararası ilişkilerdeki algı açısından birtakım farklılıkları da beraberinde getirmiştir. Değişen ve gelişen yeni dünya düzeniyle birlikte devletlerin ortak güvenlik ve savunma konularında duyduğu gereksinimleri artmıştır. Küreselleşmenin etkisi kendini askeri alanda da göstermiş, devletler diğer devlet ülkeleri üzerinde askeri kuvvetlerini bulundurma eğilimi göstermiştir. Bu durumun altında yatan sebeplerden biri de, uluslararası alanda ittifak arayışı ve zorunluluğudur. Bir devletin askeri kuvvetleri çeşitli nedenlerle diğer ülkelerde görev yapabilmektedir. Genellikle devletler imzalanan uluslararası antlaşmalarla karşılıklı olarak diğer devlet ülkelerinde askerlerini bulundurmaktadır. Uluslararası hukuk kapsamında ifa edilmesi gereken görev maksadıyla yabancı ülkelerde bulundurulan söz konusu şahısların yüklendikleri görevin mahiyeti ve önemi açısından özel statüye tabi tutularak korunması gerektiği düşünülerek, antlaşmalarda bu şahıslara bazı dokunulmazlıklar ve ayrıcalıklar tanınmıştır. Bu çalışmamızda; ülkemizde örneklerine sıklıkla rastladığımız NATO ve BM örgütlerine mensup askeri şahısların hukuki statüleri ve özellikle ceza yargısı alanında sorumlulukları, ilgili uluslararası antlaşmalar ve mevzuat hükümleri çerçevesinde incelenmiştir. Tezimizde; öncelikle ceza kanunlarının yer yönünden uygulanmasına ve asker kişi kavramına ilişkin konular anlatılmış olup ülkemizde uygulamasıyla en sık karşılaşıldığı için NATO'ya ve BM'ye mensup askeri şahısların hukuki statüsü, işledikleri suçlardan dolayı yargılanmaları, devletlerin yargılama yetkisine sahip olduğu durumlar ve diğer hususlar uluslararası antlaşmalar bağlamında irdelenmiştir.
The events that took place in the historical process and especially the demolitions that occurred in the Second World War brought about some differences both in terms of states and in terms of perception in international relations. Thanks to both changing and evolving new world order, the issues regarding common security and defense of states have increased. The impact of globalization has shown itself in the military field, and states have showed tendencies of having their military forces on the territories of other states. One of the underlying reasons of this situation, is the search for alliance and obligations on the international arena. The military forces of a state can serve in other countries for various reasons. Generally, international agreements signed between concerned state countries allows states to keep their troops in other state countries. Under the framework of International law, in order to protect stationed personnel abroad; some immunities and privileges have been recognized in the treaties by subjecting them to special status according to the nature and importance of the expected tasks to be carried out in foreign countries. In this work; The legal status of military personnel of NATO and UN organizations, whose cases we frequently encounter in our country and especially, their responsibilities in the field of criminal justice, have been examined within the framework of the relevant international treaties and legislative provisions. Under our thesis; firstly, subjects regarding the implementation of criminal laws and the concept of military personel have been explained. Secondly, the legal status of the UN and NATO's military personnel as the most frequently encountered case in our country, the prosecution of their committed crimes and cases over which states have jurisdiction as well as other relevant issues under the conext of international treaties have been examined.
