Atatürk Devrimleri İçinde Türk Medeni Kanunu'nun Yeri ve Önemi

Abstract

ÖZET Yüksek Lisans Tezi ATATÜRK DEVRİMLERİ İÇİNDE TÜRK MEDENÎ KANUNU'NUN YERİ VE ÖNEMİ Fikret BARAN Fırat Üniversitesi Sosyal Bilimler Enstitüsü Tarih Ana Bilim Dalı 1999, Sayfa: 75 Medenî Kanunlar yurttaşların kişilik, aile, miras, eşya ve borçlara ait yaşam ilişkilerini düzenlerler. Toplumsal yaşamı bu kadar geniş kapsayan Medenî Kanun'da yapılacak bir değişiklik her halde toplumsal ilişkilere de o oranda yansıyacaktır. Çağdaş değerleri ihtiva eden Türk Medenî Kanunu, Atatürk Devrimlerinin temel hedefi olan, çağdaş toplum ve çağdaş insanı yaratma idealinin gerçekleşmesinde, toplum yaşamındaki belirtilen işlevi nedeniyle en etkin araç olmuştur. Türk Medenî Kanunu Türklerin İslâmiyet'i kabul etmelerinden itibaren on bir asır boyunca uyguladıkları dinî temellere dayalı İslâm özel hukukunun yürürlüğüne son vererek, yerine kaynağmı toplumsal yaşam ve onun gereklerinin oluşturduğu lâik hukuk düzenini getirmiştir. Türk Medenî Kanunu sayesinde, ülkemizdeki azınlıklar yüzlerce yıllık imtiyazlarından vazgeçmişler, böylece Büyük Devletlerin egemenlik ve bağımsızlığımıza müdahale kapıları olan, konsolosluk ve cemaat mahkemeleri tarihe karışarak, Tanzimat'tan beri devam eden hukuk birliğini sağlama çabaları başarıya ulaşmıştır. İşte bu nedenlerle, 4 Ekim 1926 tarihinde yürürlüğe giren Türk Medenî Kanunu Atatürk Devrimleri içinde özel bir yere ve öneme sahip olup, bu husus tezimizin ana temasını oluşturmaktadır. The Civil Codes arranges the personality, family, inheritence, property and obligation relationships of citizens. By including as this much region of social life, making a change at the Civil Code will reflect to the relationships in social life in that rate. Turkish Civil Code plays a great role in the subject of formation of a modern society and modern personality ideal, which is the basic aim of Atatürk Revoluions, includes modern criterions and has been the most importent factor in the social life. Turks stopped the effectiveness of Islam Private Law depending onreligionus principles, which was applied for eleven century, instead of it Turkish Civil Code brought a laic law system which takes its source from the social life and its necessity. With Turkish Civil Code, minorities had relinquished from their concessions, thus consular and minority courts which were the opening doors to interfere our independence by the other countries became a history and the efforts for the union of the law was succeeded. Because of these reasons, Turkish Civil Code which has been in action by the date of 4 Nowember 1926 has a special role and importence.This subject is the main idea of our thesis.
