Publication: Süre Bakımından Türk İş Hukuku İle İslam Hukukunun Mukayesesi
Abstract
Bu çalışmada İş akitlerinde süre konusu, İslam Hukuku çerçevesinde icare akdi özelinde, Türk Borçlar Kanunu çerçevesinde de iş sözleşmeleri kapsamında ele alınarak bu akitlerde süre kavramı, sürenin önemi ve hukuki neticeleri incelenmiştir. Çalışma, giriş bölümü dahil olmak üzere toplamda üç bölümden oluşmaktadır. Giriş bölümünde konunun muhtevası, kapsamı ve önemi değerlendirilmiştir. İkinci bölümde icare akdi, icare akdinin tanımı, meşruiyeti ve ilgili temel kavramlar üzerinde durulmuştur. Ayrıca bu bölümde iş akitleri ve çeşitleri hem İslam hukukuna göre hem de Türk iş hukukuna göre detaylı olarak ele alınarak mukayese edilmeye çalışılmıştır. Üçüncü bölümde iş akdinde süre konusu İslam hukuku ve Türk iş hukuku çerçevesinde mukayese edilerek ele alınmıştır. Bu kapsamda iş akitlerinde süre, sürenin belirsizliği, akde olan etkisi ve hukuki neticeleri detaylı olarak incelenmiştir. Sonuç kısmında ise iş akitleri ve iş akitlerinde süre hakkında elde edilen analizler değerlendirilerek elde edilen sonuçlar ele alınmıştır.
In this study, the issue of duration in employment contracts is examined within the framework of Islamic Law, specifically in relation to the contract of hire (ijārah), and within the framework of the Turkish Code of Obligations, in relation to employment contracts. The concept of duration, its significance, and its legal consequences in these contracts are analyzed in detail. The study consists of three main sections, including the introduction. The introduction presents the scope, content, and significance of the subject. In the second section, the ijārah contract is addressed through its definition, legitimacy, and fundamental related concepts. Moreover, employment contracts and their types are discussed comprehensively and comparatively, both from the perspective of Islamic law and Turkish labor law. The third section deals with the subject of duration in employment contracts, again from a comparative perspective between Islamic law and Turkish labor law. Within this context, the issue of duration, uncertainty of duration, its impact on the contract, and its legal consequences are examined in detail. In the conclusion, the findings and analyses regarding employment contracts and the concept of duration within these contracts are evaluated, and the resulting conclusions are presented.
