İşçinin Hak ve Borçları Bakımından Türk İş Hukuku ile İslam Hukukunun Mukayesesi

Abstract

Bu çalışma dört bölümden oluşmaktadır. Birinci bölümde, çalışmanın omurgasını teşkil eden icâre, ecir/işçi, ücret, işveren, işyeri ve işletme gibi temel kavramlar izah edilmiştir. İkinci bölümde iş akdinin devamı esnasında işçinin hak ve borçları ele alınmıştır. Bu bölümde ve çalışmanın genelinde söz konusu olan işçinin borçları aynı zamanda işverenin haklarıdır; işçinin hakları da işverenin borçlarıdır. Üçüncü bölümde iş akdi sona erdikten sonra işçi ve işverenin hak ve borçları ele alınmıştır. Son bölümde işçinin sosyal güvenliği ele alınmıştır. Bu bölümün daha iyi bir şekilde anlaşılması için başta bir giriş mahiyetinde genel olarak sosyal güvenlik hakkında bilgi verilmiştir. Sonuç kısmında ise elde edilen neticeler ifade edilerek çalışma tamamlanmıştır. Anahtar sözcükler: İşçi, İşveren, Borç, Hak, Hukuk.

This study consists of four chapters. The main concepts such as rent, rental, pay, employer, working place, and business forming basic body of this study were explained in the first chapter. In the second chapter, rights and debts of workman and employer were dealth with during continuation of work contract. İn this chapter and the generality of study, debts of workman are also rights of employer; however, rihts of workman are debts of employer. In the third chapter, rights and debts of workman and employer were dealt with, after work contract had been come to an end. In the last chapter, social guarantee of workman was dealth with. Social safety was generally informed in the beginning as an introduction in order to understand this chapter better In the conclusion chapter, this study has been finished by expressing results which were reached in the thesis finally.
