İslâm Hukukuna Göre Gizli Nikâh Sebepleri ve Sonuçları

Abstract

Nikâh, evlenme ehliyetine sahip olan ve evlenmelerinde dinî veya sosyal yönden herhangi bir engel bulunmayan bir kadınla bir erkeğin, şahitler huzurunda karşılıklı rızalarını açıklamalarından ibaret olan bir sözleşmedir. Bu sözleşmeyle birlikte hem tarafları hem de toplumu ilgilendiren birtakım sonuçlar meydana gelir. İslâm hukukuna göre geçerli bir evliliğin meydana gelmesi ve nikâhın amacına uygun olarak birtakım sonuçlar meydana getirmesi için gerekli olan şartlar vardır. Bu şartların en önemlilerinden biri de nikâhın gizli olmamasıdır. İslâm hukukçuları nikâhın alenî olması konusunda görüş birliğine varmışlardır. Ancak alenîliğin nasıl sağlanacağı, aleniyetin vasıtalarının neler olduğu ve hangi nikâhın gizli nikâh sayılacağı konuları tartışılmıştır. Gizli nikâhın tanımıyla ilgili meydana gelen görüş ayrılıkları, bu nikâhın sonuçlarını da etkilemiş ve gizli nikâhın sonuçlarıyla ilgili farklı değerlendirilmeler yapılmıştır. Tezimizde gizli nikâhın sebepleri ve sonuçlarıyla ilgili olarak İslâm hukukçuları arasındaki görüş ayrılıklarına yer verilmiş ve günümüz şartları da göz önünde bulundurularak, tarafların gizli nikâh yapmaktaki amaçları ve bunun sakıncaları ortaya konmaya çalışılmıştır. Anahtar Sözcükler: nikâh, şahitlik, ilan, nikâh-ı sırr.Marriage is a contract that consists of a man and a woman who has a license to marry and who declares their mutual consent in the presence of witnesses. With this contract, there are some results that concern both the parties and the society. According to Islamic law, there are necessary conditions for a valid marriage and for the purpose of the marriage to bring about some results. One of the most important of these conditions is that the marriage is not clandestine. Islamic jurists have reached a consensus on the fact that the marriage should be public. However, the topics of how to ensure publicity, the means of publicity, and which marriage are to be considered as clandestine marriages are discussed. The differences of opinion about the definition of the clandestine marriage also affected the results of this marriage and different evaluations were made about the results of the clandestine marriage. In our thesis, the dissensus between the Islamic jurists regarding the reasons and consequences of the clandestine marriage were taken into consideration and the aims and the drawbacks of the parties in making a clandestine marriage were considered by considering the current conditions.
