Abstract
765 sy TCK'nın yürürlükte olduğu dönemde ülkemizde, bir kişinin cinsel ilişkiye girip girmediğinin tespitine yönelik muayene edilmesi, kontrolsüz, gelişigüzel ve herhangi bir makamın kararına bağlı olmaksızın yapılmaktaydı. Türkiye'nin AİHM tarafından mahkûm edilmesine de yol açan onur kırıcı bu uygulama, namus cinayetlerine ve intihar vakalarına neden olmuş ve bilhassa genç kızların, okul müdürleri veya ebeveynleri tarafından bekâret kontrolüne götürülmesi Türk kamuoyunda tepki ile karşılanmıştır. Ortaya konan bu tepki, 5237 sayılı Türk Ceza Kanunu'nda karşılığını bulmuş ve kişilerin, yetkili hâkim ve savcı kararı olmaksızın genital muayeneye gönderilmesi veya bu muayenenin yapılması fiili suç olarak düzenlenmiştir. Bu çalışmada 5237 sayılı Türk Ceza Kanunu'nun 287. maddesinde düzenlenmiş olan "Genital Muayene" suçunun unsurları ve özellikleri, doktrinde ileri sürülen görüşler ışığında ele alınmıştır
Examination of whether a person had sexual intercourse was done beyond control, irregularly and without any authority's decision when Turkish Penal Code (765) was in force at the time in Turkish Republic. This degrading practice, also led to the conviction of Turkish Republic by ECHR, has caused honor killings and suicides. Taking of young girls to virginity test by their parents or school principals has especially met the reaction of Turkish public opinion. This reaction has found response in the Turkish Penal Code numbered 5237 and taking a person to genital examination without decision of authorized judge and public prosecutor as well as doing this examination were set as crime. In this work, elements and features of "genital examination" crime set in the art. 287 of the Turkish Penal Code numbered 5237 has been examined under the doctrinal views
