Abstract

Dr. Mustafa TÜYSÜZ Türk haksız rekabet hukukunda yeni olan dürüstlük kuralına aykırı genel işlem şartları kullanımı ve yaptırımı ticari ve hukuki hayatta oldukça önemlidir. Zira ticari alanda güçlü olanlar güçsüz olanlara dayatmalarda bulunarak haksız rekabet oluşturmakta ve böylece hukuk kurallarını ihlal etmekteler. Bir genel işlem şartının haksız rekabet oluşturabilmesi için bazı şartlara ihtiyaç vardır. Bu şartlar şöyledir; ortada en azından bir sözleşme olmalı, genel işlem şartları kullanılmalı ve bu kullanım dürüstlük kuralına aykırı bulunmalı, iktisadi alanda rekabet olmalı, zarar veya zarar görme tehlikesi ortaya çıkmalı ve bu şartlar arasında da uygun illiyet bağı bulunmalıdır. Dürüstlük kuralına aykırı genel işlem şartı kullanılması sonucu haksız rekabet oluştuğu takdirde, ilgililer, tespit, men (önleme), düzeltme ve zarar ve kusur varsa tazminat davalarını açabilirler. The Usage and Sanction of General Terms and Conditions Against Good Faith in Turkish Unfair Competition Law Ayhan BAKIR Ondokuz Mayıs University, Institute of Social Sciences Department of Private Law, Master of Laws (LLM), 06/2016 Supervisor: Doç. Dr. Mustafa TÜYSÜZ The usage and sanction of general terms and conditions against good faith which is new in Turkish Unfair Competition Law is very significant in judicial life. This is caused by the powerful imposing on the weak in the trading domain, by creating unfair competition and therefore violating legal rules. There needs to be certain conditions for a general term and condition to create unfair competition. These conditions are the following: there needs to exist at least one contract, general procedure conditions must be used and this usage should be against the rule of good faith, there needs to be competition in the trading domain, damage or a danger of damage should become apparent and there should be an appropriate causal connection among these conditions. In case an unfair competition occurs as a consequence of the usage of general terms and conditions in a way that violates the rule of good faith, concerned ones could suit for detection, prohibition (repression), correction and damages or faults if there exists any.
