Fakih Sahâbîler

Abstract

Sahâbîler dini doğru bir şekilde öğrenme, anlama ve yaşama gayretindeydiler. Hz. Peygamber'e düşkünlükleri ve ilim öğrenme arzusundan dolayı onun yanından bir an bile olsun ayrılmamaya özen gösteriyorlardı. Hz. Peygamber'den sadır olan sözleri ezberliyor, onun yaptığı fiillere tanıklık ediyorlardı. Böylece doğrudan Hz. Peygamber'den aldıkları bu hadisleri ve bilgileri kendilerinden sonraki kuşağa aktarma imkânı buldular. Kendilerinden sonra gelen bütün İslâm bilginleri başka hiçbir yerde bulma imkânına sahip olmadıkları bu bilgileri onlardan aldılar. Bundan dolayı Kur'ân'ın, sünnetin ve İslâm'ın korunması ve doğru anlaşılması noktasında büyük bir öneme sahiptirler. Bizde bu çalışmamızda fetvâ ehliyetine sahip olan fakih sahâbîlerin hayatlarını, nasları anlama ve yorumlama biçimleriyle karşılaştıkları yeni meselelere çözüm getirirken kullandıkları yöntem ve başvurdukları kaynakları inceleme konusu yaptık. Bu bağlamda hayatlarını ele aldığımız fakih sahâbîleri verdikleri fetvâ yoğunluklarına göre çok sayıda fetvâ verenler, orta derecede fetvâ verenler ve az sayıda fetvâ verenler olarak gruplandırıp kısaca hayatlarını verip ilmi kişiliklerini inceledik. İlmi kişiliklerini incelediğimiz fakih sahâbîlerin vermiş oldukları fetvalardan tespit edebildiklerimizi kaleme aldık. Anahtar Sözcükler: Sahâbe, Fetvâ, İctihad, Kazâ

Companions of Prophet Muhammad (Sahabas) tried to learn, understand and experience the religion properly. Because they devoted themselves to Prophet and desired to learn science, they didn't leave him even a moment. They learned the words of Prophet Muhammad by heart, were witnesses to the activities he did. So they found the opportunity to transmit these hadiths (Prophet Muhammad's sayings and deeds) and information to the next generation. All the next islamic scholars obtained these information from them which they couldn't find anywhere else. Therefore they have a great importance in preservation and good understanding of Koran, Sunnah and Islam In this study, as subject of study we have concentrated on the lives of faqih sahabas who had fatwa competence, and with the help of the styles of understanding and interpreting hadiths, the methods and the sources they used when they brougt solutions to the new matters they faced. In this connection we have classified the mentioned faqih sahabas as multi fatwa givers, middle level fatwa givers and limited numbered fatwa givers according to the fatwa intensities which they gave and we have presented their lives briefly and investigated their scientific personalities.
