Vâcip Kavramı Bağlamında Cessâs'ın El-fusûl'ü ve Ahkâmu'l-kur'ân'ında Usûl-fürû Tutarlılığı

Abstract

The study focuses on the consistency of usl-fiqh methods in the context of vacibal-Fusul of Jasasand Ahkamu'l-Qur'an. Generally, it is claimed that copyrighted faith methods works and fiqh methods books have a lack of consistency. In this study, information about vacib from two works on usl and fiqh was presented, and the information in the context of usl-fiqh methods evaluated by comparing. The study composed of three parts; the first part is the life and works of Jasas, the second part; the concept of vacip and the concept of vacib in accordance with al-Fusul in general, and the third part contains the consistency analysis of the vacibi in Ahkamu'l-Quran and the data in al-Fusuland Ahkamu'l-Qur'an. When the data on issues such as vacib generating from the sunnah in al-Fusul and Ahkamu'l-Qur'an, the relationship between the order and the wajab, the muwessa, interim and consignment vacib are evaluated, it is obviously seen that the issues are eligible each other, there is a consistency between them, and there is no situation that can be directly or indirectly defined as a contradiction. It is confirmed that the consistency of usl-fiqh in the context of vacib in al-Fusul and Ahkamu'l-Quran of Jasas is incisively reflected. Keywords: Order, Decision, Necessity

Çalışmada Cessâs'ınel-Fusûl ve Ahkâmu'l-Kur'ân'ındavâcip bağlamında usûl-fürû tutarlılığı araştırılmıştır. Genelde telif edilen usûl eserleri ve fürû kitaplarının tutarlılık noktasında eksik olduğu iddia edilir. Bu çalışmada usûl ve fürûa dair iki eserde vâcibe dair yer alan bilgiler sunulmuş, bilgiler usûl-fürû bağlamında mukayese edilerek değerlendirmeye tâbi tutulmuştur. Araştırma üç bölümden teşekkül etmekte olup; birinci bölüm Cessâs'ın hayatı ve eserlerini, ikinci bölüm; genel olarakvâcip kavramını ve el-Fusûl'devâcip kavramını, üçüncü bölüm ise Ahkâmu'l-Kur'ân'davâcibi ve el-Fusûl ve Ahkâmu'l-Kur'ân'daki verilerin usûl-fürû tutarlılık analizini kapsamaktadır. el-Fusûl veAhkâmu'l-Kur'an'da yer alan; sünnetten kaynaklanan vâcipler, emir-vücûb ilişkisi, müvessâ, muvakkat ve muhayyer vâcip gibi konulara ilişkin verilerin birbirine muvâfık olduğu, eserler arasında tutarlılığın bulunduğu, doğrudan ya da dolaylı biçimde çelişki olarak nitelendirilebilecek bir durumun bulunmadığı görülmektedir. Cessâs'ınel-Fusûl ve Ahkâmu'l-Kur'ân'ındavâcipbağlamında usûl-fürû tutarlılığı isabetli biçimde yansıtıldığı tespit edilmiştir. Anahtar Sözcükler: Emir, Hüküm, Vücûbiyet
