Türk Hukukunda Bir Kusursuz Sorumluluk Türü Olarak Objektif Özen Ödevine Dayalı Sorumluluk

Abstract

Teknik gelişmeler ve ona bağlı olarak tehlikelerin artması, kusuru ispat güçlüğü ve zarar görenin kusurunun bulunmadığı durumlarda, zararın bu kişinin üzerinde bırakılmaması gibi düşünceler kusursuz sorumluluk ilkesini beraberinde getirmiştir. Buna bağlı olarak, Türk hukukunda kusursuz sorumluluk halleri, objektif özen ödevine dayalı kusursuz sorumluluklar, hakkaniyete dayalı kusursuz sorumluluk ve tehlike sorumluluğu şeklinde karşımıza çıkmaktadır. Objektif özen ödevine dayalı kusursuz sorumluluklar, Türk Medeni Kanunu ve Türk Borçlar Kanunu başta olmak üzere çeşitli kanunlarda düzenlenmiştir. Bu kusursuz sorumluluklar arasında; adam çalıştıranın sorumluluğu, hayvan bulunduranın sorumluluğu, yapı malikinin sorumluluğu, ev başkanının sorumluluğu ve taşınmaz malikinin sorumluluğu teori ve uygulama açısından bir hayli önem arz etmektedir. Adam çalıştıranın sorumluluğu, hayvan bulunduranın sorumluluğu ve ev başkanının sorumluluğunda, özene dayalı kurtuluş delili getirme imkânı tanınmıştır. Yapı malikinin sorumluluğu ve taşınmaz malikinin sorumluluğunda ise bu imkân tanınmamıştır. Anahtar Kelimeler: objektif özen, kusursuz sorumluluk, kurtuluş delili, adam çalıştıran.

Technical developments and the increasing of dangers depending on it bring about the principle of strict liability in addition to some thoughts that the damage shouldn't prejudice this person when the loser doesn't have defect. Accordingly, in Turkish Law, conditions of strict liability consist of those based on objective duty of care, the ones based on justice and the danger responsibility. Strict liabilities based on objective care duty were issued with various laws like mainly Turkish Civil Code and Turkish Code of Obligations. In these strict liabilities, the responsibility of the employer, the responsibility of the possession of an animal, the responsibility of house owner, the responsibility of head of the house and the responsibility of real estate owner have great important in terms of theory and practice. The oppurtunity of evidence of release based on care was enabled for the responsibility of the employer, the responsibility of possession of an animal and the responsibility of head of the house. But, it wasn't enabled for the responsibility of house owner and the responsibility of real estate owner. Key words: objective care, strict liability, evidence of release, employer.
