42 1769 No`lu Samsun Şer`iyye Sicilinin Transkrip ve Tahlili

Abstract

Şer'iyye sicilleri Osmanlı Devleti'nin mahkeme kayıtlarından oluşan birinci eldenkaynaklardır. Bu belgeler yıllık olarak mahkemeye intikal eden siyasû, sosyal, hukukû vebenzeri konuları içerir. İncelediğimiz defter 42/1769 numaralı Samsun'a ait bir defterdir.Çalışma giriş haricinde iki bölümünden oluşmaktadır. Girişte şer'iyye sicilleriyle ilgili genelbilgiler verilmiştir. Ayrıca incelenen defterin genel durumu ve kısa bir Samsun tarihine yerverilmiştir.Birinci bölümde defterin transkripsiyonu yapılmıştır. Ancak transkripsiyonun yanısıra, defterde yer alan kayıtlar tek tek numaralanarak konularına göre başlıklar halindeayrılmıştır. Bu bağlamda veraset, alım-satım, evlenme-boşanma, hırsızlık gibi siyasû, sosyalve ekonomik bir çok konu başlıklar halinde belirlenmiş okuyucunun bilgisine sunulmuştur.İkinci bölümde ise defterde yer alan kayıtlar genel bir değerlendirmeye tabitutulmuştur. Defterde çok sayıda evlenme, boşanma, alım-satım davaları, veraset davaları,kişisel davalar, hırsızlık olayları gibi konular yer almıştır. Bu konular defterde yer alankayıtlar çerçevesinde değerlendirilmiştir. Legal Documents consist of the first hand Ottoman court documents. Thesedocuments include some political, social, legal and other matters that have legalaspects. The document that we examine is the Document of number 42/1769belonged to Samsun. The study consists of one introduction and two chapters. Theintroduction gives about some general information about the Ottoman legaldocuments. It also deals with some general features of the document that we examineand the history of Samsun.In the first chapter, the transcription of the document was made. Besides thetranscription, all records are numbered and titled according to their subjects. In thiscontext, many subjects such as political, social and economic including inheritance,buying and selling, marrying and divorce, thieving are arranged as a topic andpresented to the readers.In the second chapter, the records in the document are evaluated. The documentincludes many matters such as marrying, divorce, the problem of buying and selling,the trial of inheritance, individualistic trials, and thieving. These matters areevaluated in terms of records taken place in the document. In addition, in order tocompare with the original one, the original texts are attached at the back of the study.
