İslam Hukukunda Çocuk İşçiliği

Abstract

'Çocuk işçiliği' çocukları eğitimlerinden alıkoyan ve onların maddi ve manevi varlıklarına zarar veren ve toplumların geleceğini karartan sosyal bir olgudur. Öte yandan günümüz çocuk hukukunda çocuğun çalışmasına, mesleki formasyon ve kabiliyetleri geliştirmesi bakımından olumlu bakılmakta ve 'çalışan çocuk' kapsamında ele alınmaktadır. İslam Hukukunda 'neslin muhafazası' ilkesi doğrultusunda nafaka sorumlusu olan kişiler belirlenerek, çocuğun geçimi teminat altına alınmış ve çocuğun eğitimine engel olacak işçilik faaliyetleri yasaklanmıştır. Bununla birlikte, temel eğitim kapsamında görülen mesleki bilgi edinebilmesi ve gelecekteki sorumluluklarına hazırlanabilmesi için iş hayatında rol verilebileceği, belli kayıtlarla kabul edilmiştir. Çocuğun iş hayatında istihdam edilmesi veli veya vasilerin gözetimi altında olması şartıyla meşru görülmüştür. Belirli koşullar ve kayıtlarla çalışması kabul edilen çocuğun istismar ve ihmaline yol açabilecek su-i istimaller yasaklanmıştır. Bizzat Hz. Peygamber (s.a.v.) tarafından çocuğa bazı yetiştirici sorumluluklar veril-miş, Osmanlı uygulamasında da ahilik teşkilatı bünyesinde çocuk, eğitimi için çalıştırılmıştır. Hatta çocuğun ibadet, ceza, aile, hukuki ve mali olmak üzere bütün işlemlerinde tam ehliyet sahibi olabilmesi ve çocukluk döneminin tamamen sona erebilmesi için gerekli görülen reşit olma vasfını kazanmasında, çalışma hayatında lehine olan işlemleri gerçekleştirebiliyor olması, bir ölçü olarak kabul edilmiştir. Böylelikle İslam Hukuku uygulamasında çocuk işçiliği, çocuğu eğitiminden alıkoyan değil, çocuğun gelişimine katkı sağlayan bir eğitim süreci olarak ortaya çıkmıştır.

In this work, the jurisprudential perspective of children employment of school age is discussed. An important reason for choosing this topic is the fact that there are nowritten works in this area over MA level. One of our main objectives in this work is to bring up various provisions of Islâmic law regarding children's rights. In our thesis, which covers the concept of ''child'' via various schools of law, childhood periods are analyzed by considering their relationship with employment. Accordingly, the rights of children in Islâmic law have been included according to their relevance to the subject. However, those that are not relevant have been excluded. In our thesis, the reasons for children employment along with its positive and negative effects on the child have been discussed. Also, the results of his own and his mother's work were examined within the context of child abuse and neglect. 'Children employment' is a status that prevents children from their education, damages their material and spiritual existence and has a negative impact on the future of socities. On the other hand, it is also considered positively in terms of pro-fessional formation and skills and is considered within the framework of 'working child'. According to the principle namely ''protection of generation'' in Islâmic law, the livelihood of the child has been secured, employment activities that prevents the child from education are prohibited. In order, to obtain professional information and prepare for future responsibilities within the framework of basic education, it has been accepted under certain conditions.
