Pozitif Hukuktaki Asgari Ücret Uygulamasının İslam Hukuku Bağlamında Analizi

Abstract

Bu çalışmada asgarî ücret, önce Türkiye'de yürürlükteki şekliyle, ardından da İslamhukukundaki zemini ve farklı boyutları ile ele alınmıştır. Pozitif hukuktaki biçimiyle asgariücretin tanımı, hukuksal zemini, asgari ücret tespitinde belirleyici ölçütler, asgari ücretinuygulanması ve asgari ücret tespitinde gözetilen temel amaçlar sunulmuştur. Çalışmanındevamında, İslam hukuku perspektifiyle, temel ihtiyaçların asgari standartları, nafaka mükellefiyeti,devletin ücret piyasasına müdahalesi, sosyal ve ekonomik şartların ücret tespitindeki rolü veişçinin korunması meseleleri ele alınmış; ulaşılan sonuçlar ifade edilerek çalışma tamamlanmıştır.

The Analysis of the Minimum Wage Implementation in the Context of Islamic LawIn this article, firsly, minimum wage has been discussed by its current form in Turkey, thenit's legal background has been addressed with its different dimensions.  In this context, thedefinition of minimum wage, it's legal background, decisive criteria in determining the minimumwage, the implementation of the minimum wage and basic goals in determining the minimumwage have been expressed. Thereafter, minimum standarts of basic needs, alimony liability, government's intervention in the market, the role of the social and economic conditions in wage determination and protection of workers have been  analysed with the perspective of Islamiclaw. This article has finalised by expressing attained results.
