Türk ve İran Hukuklarında Evlenme ve Boşanma Hükümleri

Abstract

Türk ve İran Hukuklarında evlenme ve boşanma hükümleri incelerken bu kurumun düzenlenmesinde önemli farklılıklar önümüze çıkmıştır; kavramsal ve tarihsel arka planın başlangıcında boşanma koşullarını ve nedenlerini tanımlamak ve gözden geçirmek için çalışılmalıdır. Ancak, hem İran hem de Türk hukuk sistemlerinde evlenme ve boşanma hükümleri iki farklı yaklaşımdan geldiği anlaşılmaktadır. Özellikle Boşanma hukukuna ilişkin hükümlerin niteliği, her iki ülkenin yasama meclisinin egemenlik yaklaşımlarından ve algılamasından etkilenmektedir. İran Hukuk sistemi esas itibariyle İslam Hukuku üzerine kuruludur ve İslam Hukukunun hareket noktası çok farklıdır. Türkiye'de 1926 yılında Hukuk sistemi İnkılabıyla başlayan, Kıta Avrupası Kanunnamelerinin bu cümleden olarak İsviçre Medeni Kanunu'nun iktibası sonucu Türk Aile Hukuku Kurallarının bu arada evlenme ve boşanma hükümleri hukuku kurallarının Roma-Cermen Hukuk Sistemine uygun olarak teşkil edildiği görülmektedir. Bu çalışmamızda birer ayrı iki hukuk sistemi olarak İran ve Türk Hukuklarında evlenme ve boşanma hükümleri ilişkin hükümler incelenmiş, üç bölümde evlilik ve boşanma kavramı ile boşanmanın etkileri ve boşanmanın hukukî sonuçları ele alınmıştır. When examining the divorce law in Iran and Turkish Laws, important differences have arisen in the organization of this institution. However, it should be briefly stated that the divorce conditions in both Iranian and Turkish legal systems come from two approaches. The quality of the divorce is influenced by the perception of the sovereign approaches of the legislatures of both countries. The Iranian legal system is based on the Islamic law of Islam, and the theme of Islam is more abundant. However, this attitude has changed and divorce and legal status in Turkey with a secular approach has resulted in more side from the Roman and German legal system and the root of the Swiss of Turkish law is explained to be the West law. However, the following two legal systems consider the conditions of divorce in Iranian and Turkish law. In this study, the provisions of the marriage contract and the principles of divorce in Iran and Turkish Laws as two separate legal systems are examined and the concept of marriage and divorce, the effects of divorce and the legal consequences of divorce are discussed in three sections.
