Publication: Tüketici Hukuku Kapsamında Hasta Hekim İlişkisi
Abstract
6502 Sayılı Tüketicinin Korunması Hakkında Kanun, 28 Kasım 2013 tarihinde Resmi Gazetede yayımlanmış ve birçok değişikliği beraberinde getirmiştir. Mülga Kanun'dan farklı olarak, vekâlet ve eser sözleşmelerinin tüketici sözleşmesi olarak kabul edilmesi bunlardan birisidir. Bunun sonucunda, hekimlik sözleşmesi ve hastaneye kabul sözleşmesi de Tüketici Hukuku kapsamında değerlendirilmeye başlanmıştır. Çalışmamızda, hasta ile hekim arasındaki sözleşme ilişkisinin Tüketici Hukuku kapsamında değerlendirilerek, tüketici sözleşmesi niteliğinde olup olmadığı incelenmiş; hekimlik sözleşmesinin tüketici sözleşmesi olarak kabul edilmesinin sonuçları açıklanmış ve bu konuda tespit edilen aksaklıklar belirtilmiştir. Buna göre hasta, aynı zamanda bir tüketici olarak hakkını aramak için Tüketici Hakem Heyeti, arabulucu ve Tüketici Mahkemesine başvurabilmektedir. Yine çalışmamızda belirtilen hukuki yollara başvuru şartları ve hasta açısından fayda ve mahsurları da değerlendirilmiştir. Bununla birlikte hasta hekim ilişkisini Tüketici Hukuku açısından incelediğimiz her noktada tıp etiği kuralları da göz önünde bulundurulmuştur. Sonuç olarak; 6502 Sayılı Tüketicinin Korunması Hakkında Kanun'da yer alan hükümler ile birlikte, hasta hekim arasındaki sözleşme ilişkisi, tüketici sözleşmesi olarak kabul edilse de bu durumun uygulamada birçok sorunu da beraberinde getirdiği görülmüştür.

Acceptance of the contractor agreement and contract of mandate, as consumer contracts, differently from the repealed article is one of them. As a consequence, the medical contract and contract of admission in a hospital are also began to evaluate under the Law on Consumer. In this study, the contractual relation between doctor and patient was evaluated under the Law on Consumer and it was examined whether it was a consumer contract or not. The conclusions of the acceptance of medical contract as a consumer contract was explained and the established problems of this topic have been stated. As a consumer, the patient can make an application to Consumer Arbitration Committee, Consumer Court and arbitrageur to claim their rights. The advantages and disadvantages of making an application to the stated legal procedures was evaluated from the point of patient. However, Medical Ethics Rules either were taken into consideration at every point that were examined the patient and doctor relationship in terms of Law on Consumer. As a result, it brings so many problems together in practice although there is some legal arrangements related to the acceptance of contractual relation between patient and doctor as a consumer contract.
