Şafiî Fıkıh Literatüründe Yer Alan Aile Hukukuyla İlgili İcmâların Tespit ve Analizi

Abstract

Ümmetin müctehitlerinin bir konu üzerinde ittifak etmesi demek olan icmâ, İslam dininin sabitelerinden olup hükme kaynak olma cihetiyle oldukça kuvvetli bir dayanaktır. Diğer mezheplerde olduğu gibi Şâfiî mezhebi de görüşlerini meşru bir zemine oturtmak için icmâya oldukça önem vermiş, hüküm çıkarmada onu dikkate almıştır. Çalışmada, Şâfiî mezhebinin aile hukukundaki icmâlarını araştırırken bunların mezhepler arası kabul gören ümmetin icmâsı mı yoksa mezhep içi âlimlerin ittifakı mı olup olmadığını tespit etmek için, Şâfiîlerin aile hukukuna dair icmâ var dediği konular, diğer mezheplerin (Hanefî, Mâlikî ve Hanbelî) klasik fıkıh kaynaklarına başvurularak incelemeye alınmış ve tahkik edilmeye çalışılmıştır. Her mezhebin kendi bünyesindeki birincil kaynaklar araştırmamızda evvelîyetle tercih ettiğimiz dayanaklarımız olmakla birlikte, ihtiyaç duyuldukça yakın zaman âlimlerinin eserlerine de zaman zaman yer verilmiştir. Yapılan incelemeler göstermiştir ki Şâfiîlerin, icmâ diye bahsettiği bazı noktalar, mezhep içi ittifak olarak ortaya çıkmaktadır. Çalışmamızda Şafiîlerin aile hukukuyla ilgili üzerinde icmâ mevcut dedikleri 83 mesele tespit edilmiş olup, bu meselelerin 61 tanesinde diğer mezhepler de Şafiîlerle aynı görüşü savunmakta, 22 tanesinde ise muhalefet ettikleri görülmektedir. Bu tespitleri yaparken mezheplerin öne sürdüğü delillere de çalışmamızda yer vermeye gayret gösterdik. Bu çalışmamızdan önce, Şâfiîlerin aile hukuku alanında var dedikleri icmâların tahkikinin yapılmamış olması ve bu iddia edilen icmâların dört meşhur mezhebin kaynaklarına müracat edilerek mezhepler arası bir mukayeseye de tabi tutulmamış olması çalışmamızı özgün ve önemli kılmaktadır. Her ne kadar çalışmada asıl maksat aile hukukuyla ilgili icmâları tespit etmek olsa da araştırma boyunca birçok konuya temas edilmiş ve bu sayede okuyucunun temas edilen konuların icmâ edilen fıkhi hükümler olması açısından da bilgi sahibi olması tarafımızca tâli hedef olarak belirlenmiştir.

Ijma, which means the unanimity of the scholars of the Ummah on a subject, is one of the constants of the religion of İslam and is a very strong basis for being a source of judgment. As in other sects, the Shafi'i sect also attached great importance to ijma and took it into account in issuing judgments. In the study, while investigating the ijmas in the Shafi family law, in order to determine whether these are the ijma of the ummah that is accepted between the sects or the alliance of the scholars within the sects, the issues that the shafis say have ijma were examined by referring to the classical fiqh sources of other sects. Although the primary sources within each sect are our preferred bases in our research, they have also included the works of recent scholars from time to time. As a result of the study, in order for the ijmas identified in the Shafi sect to be called the ijma of the ummah, the basic works of the other 3 sects were also examined on the subject. The investigations have shown that some of the points that the Shafis refer to as the Ummah Ijma have sometimes failed to go beyond an intra-sectarian alliance as a result of the opposition of other sects. While making these determinations, we tried to include the evidence put forward by the sects in our study, although the main purpose of the study was to determine the jurisprudence related to family law, many issues were touched upon throughout the research and thus it was determined as a desired goal for the reader to have information about the fiqh of the touched issues.
