Abstract
.Her ülkenin kendine ait bir hukuk sistemi vardır. Uygulanan yaptırımlar, kurallar yasama ve yargı organları değişiklik gösterebilir. Bu bağlamda bu tezin konusu olan Türk ve İran hukukunda motorlu araç işletenlerin hukuki sorumluluğu öncelikle bu kapsamda ele alınmıştır. Her iki ülkenin hukuk sistemindeki kavram ve uygulamaların benzer ve farklı yönleri ortaya konulmuştur. Çalışmada öncelikle sorumluluk kavramı ele alınmış ve buna bağlı olarak işleten kavramı ve işletmeden doğan sorumluluklar ile meydana gelen zararın tazmininde ortaya çıkan sorumluluk halleri incelenmiştir. Türk hukukunda 1930'lu yıllardan itibaren sorumluluk kusura dayandırılmıştır. Ancak 1953 yılında kabul edilen 6085 sayılı Karayolları Trafik Kanunu ile kusursuz sorumluluk kavramı ortaya çıkmıştır. Ancak Motorlu Taşıt İşletenin hukuki sorumluluğu 1983 yılında 2918 Sayılı Kanun ile yeniden düzenlenmiş ve bu alanda tehlike sorumluluğu ile birlikte farklı sorumluluk türleri de öngörülmüştür. Bu tezin asıl konusu Motorlu Taşıt İşletenin hukuki sorumluluğu kapsamında bu sorumluluk türlerinin özellikle tehlike sorumluluğunun her iki ülke için teori ve uygulamada nasıl ele alındığıdır. 2918 sayılı Türk Karayolları Trafik Kanunu'nda yer alan 'motorlu araç işletenin hukuki sorumluluğu' yalnızca karayolunu içerdiği için, Çalışma'da konu bu kapsamda ele alınmıştır. .All countries have their own legal structures. The sanctions or rules that are applied and legislative and judicial bodies may alter. In this regard, the legal responsibility of motor vehicle drivers in Turkish and Iranian laws, which is the subject of this thesis, is considered principally in this context. The similar and different aspects of the concepts and practices in the legal system of both countries have been put forward. In the study, firstly the concept of responsibility is considered and accordingly the concept of the operator and the responsibilities arising from the operation as well as the responsibility states arising from the compensation of the loss are examined. Since the 1930s, Turkish law has been based on liability. But the concept of absolute liability came to exist by the road traffic law which was adopted in 1953. However, in 1953, the concept of perfect accountability has emerged with the Highways Traffic Law. This law, numbered 2918, was reorganized in 1983 and different types of responsibility were considered together with the responsibility of danger. The main issue of this thesis is how these types of responsibilities are addressed, especially how the responsibility for danger is addressed to both countries. The 'motor vehicle liability' in the Road Traffic Law covers only the highroad, the subject has been addressed in this context.
