Abstract
Yabancı uyruklu gerçek kişiler, kanunlarda belirtilen sınırlamalara uymak koşulu ile Türkiye'de taşınmaz edinebilmektedir. Türk Hukuk Sisteminde yabancı uyruklu gerçek kişilerin taşınmaz edinimi, Osmanlı Döneminden günümüze kadar yapılan çeşitli düzenlemelerin neticesinde güncel haline ulaşmıştır. Yabancı uyruklu gerçek kişilerin taşınmaz edinimi konusunda en temel kanun olan 2644 sayılı Tapu Kanunu 1934 yılında yürürlüğe girmiştir. Bu kanunda yapılan en son ve geniş çaplı değişiklik, 03 Mayıs 2012 tarihinde kabul edilen 6302 sayılı Tapu Kanunu ve Kadastro Kanununda Değişiklik Yapılmasına İlişkin Kanun ile gerçekleşmiştir. Anılan Kanun ile yabancıların Türkiye'de taşınmaz edinimini kolaylaştıran yeni usul ve esaslar benimsenmiştir. Çalışmada; öncelikli olarak yabancı uyruklu gerçek kişilerin taşınmaz edinimine ilişkin mevzuatın tarihsel süreç içerisinde geçirdiği değişim incelenmiş, konuya ilişkin son düzenleme olan 6302 sayılı Kanunun getirdiği yenilikler neticesinde yabancı uyruklu gerçek kişilere yapılan taşınmaz satışlarındaki hareketlilik anlatılmıştır. Kanunun yürürlüğe girdiği 2012 yılından 2018 yılının sonuna kadar olan süreçte, yabancı uyruklu gerçek kişilerin taşınmaz edinimi rakamlarının yüksek oranlarda seyrettiği ve Türkiye'nin sanayi, kültür ve turizm alanlarında önemli yeri olan Antalya, Ankara, Bursa, İstanbul, Muğla, Trabzon ve Yalova illeri çalışma konusu yapılmıştır. Çalışmada, Türkiye İstatistik Kurumunca Türkiye'nin tamamı için yayınlanan veriler ile Tapu ve Kadastro Genel Müdürlüğü'nden bahse konu 7 il için alınan yabancı uyruklu gerçek kişilere ait satış verilerinden yararlanılmıştır. İl, ilçe, uyruk ve yıllar bazında alınan bu verilerden yararlanılarak grafik ve çizelgeler oluşturulmuş, iller ve yıllar itibariyle karşılaştırması yapılmış, yabancıların bu illerde taşınmaz edinimine sebep olan etkenler ortaya konulmuştur. Ayrıca, çeşitli uyruktaki vatandaşların il tercihlerindeki değişimler irdelenmiştir. Sonuç itibariyle, 6302 sayılı Kanunla yapılan değişiklik sonrasında, yabancı uyruklu gerçek kişilere yapılan satışlarda hem miktar olarak, hem de taşınmaz edinen ülke uyrukluğunda önemli değişimler yaşandığı görülmüştür.
Real persons of foreign nationality can acquire real estates in Turkey provided that they comply with the restrictions set out in the law. The acquisition of property by foreign nationals in Turkish Legal System has reached its current form as a result of various regulations from the Ottoman period to the present day. In 1934, Land Registry Law no. 2644, which is the most basic law on the acquisition of property of real persons of foreign nationality, came into force. The most recent and broad-scale amendments to this law have been the law on Land Registry Law No. 6302 and the law on Cadastre, adopted on 03 May 2012. With the law mentioned, new procedures and principles that increase the acquisition of property by foreigners in Turkey have been adopted. In the study; firstly, the changes in the legislation regarding the acquisition of property by real persons of foreign nationals have been examined in the historical process, as a result of the innovations introduced by the Law no. 6302, which is the latest regulation on the subject, the mobility in the sales of immovable property to foreign natural persons is explained. In the period from 2012 to the end of 2018, when the law came into force, the real estate acquisition numbers of real persons of foreign nationals were observed to be high and Antalya, Ankara, Bursa, İstanbul, Muğla, Trabzon and Yalova provinces, which are the important areas such as industry, tourism in terms of Turkey, have been the subject of the study. In the study, the data published by Statistics Authority for the whole of Turkey and the sales data of foreign real persons obtained from the General Directorate of Land Registry and Cadastre for the mentioned 7 provinces were used. Graphs and charts were created by using these data obtained on the basis of provinces, districts, nationalities and years, compared by provinces and years, factors causing the acquisition of immovables by foreigners in these provinces have been revealed. In addition, the changes in provincial preferences of citizens of various nationalities were examined. As a result, after the amendment made by Law No. 6302, it was observed that there were significant changes both in terms of quantity and in the nationality of the country that acquired the immovable.
