Abstract
Gündelik hayatımızda ve ilişkilerimizde en sık karşılaştığımız sözleşmeler; satış ve eser sözleşmeleridir. Eser sözleşmesi: iş sahibi ile yüklenici arasındaki ilişkiyi düzenlerken; satış sözleşmesi, satıcı ve alıcı arasındaki ilişkiyi düzenler. Bu iki sözleşme; taraflara bir takım külfetler, borçlar yükler ve haklar tanır. Bu yüksek lisans tez çalışmasının ana konusu, eser ve satış sözleşmesinde ayıptan doğan sorumluluk hükümleri çerçevesinde sözleşme taraflarının borçları, külfetleri, sahip oldukları seçimlik haklar ve bu hakların kazanılma koşullarıdır. Tez çalışmasının birinci bölümünde; genel olarak ayıp kavramı başlığı altında, ayıp kavramı, ayıp çeşitleri, ayıp sayılmayan durumlar incelenmiştir. İkinci bölümde; satıcının ayıba karşı sorumluluğunun maddi ve şekli şartları, hukuki niteliği, alıcının seçimlik hakları ve ayıba karşı sorumluluğunun hüküm ve sonuçları incelenmiştir. Üçüncü bölümde; yüklenicinin ayıptan doğan sorumluluğu başlığı altında, eser sözleşmesi, ayıba karşı sorumluluktan doğan hakların kullanılması için gereken şartlar, iş sahibinin ayıba karşı sorumluluktan doğan hakları incelenmiştir ve ayıba karşı sorumluluk çerçevesinde eser ve satış sözleşmeleri değerlendirilmiştir. Tez çalışmasında belirlenen konular, bilimsel görüşler ve yargısal uygulamalar çerçevesinde ele alınıp incelenmiştir. Konunun anlaşılabilmesi açısından, çalışmada Yargıtay kararları bulunmaktadır. Tartışmalı noktalarda doktrindeki görüşler belirtilmiştir. Gereken yerlerde eski ve yeni kanun hükümleri karşılaştırılmıştır. Son kısımda ise sonuç başlığı altında çalışmadan elde edilen sonuç özetlenmiştir
The contacts that we encounter in our daily lives and in our relationships are contract of sales and contract of work. Contract of work: arranges the relationship between the job holder and the contractor; on the other hand contract of sales arranges the relationship between the dealer and the buyer. These two contracts burden some debts and troubles on parties and entitle some rights. The main theme of this master's thesis is the debts, burdens of contracting parties; the right of choice they have and the conditions how these rights are attained towards defect in contract of work and sales in accordance with the warranty terms. In the first part of the thesis; the concept of defect, types of defect, the situations that are not accepted as defective, corporal and formal conditions of the responsibility of the dealer towards defect, its legal characteristic, the right of choice of the buyer and the provision and results of the responsibility of him/her towards defect have been discussed under the title of the responsibility of the dealer due to defect. In the second part of the thesis study, the contract of work, necessary conditions for the use of rights oriented from the responsibility towards defect, the rights of the job holder due to the responsibility towards defect have been analyzed under the title of the responsibility of the contractor oriented from defect and contracts of work and sales have been evaluated within the frame of responsibility towards defect. The themes stated in the thesis study have been approached and analyzed within the scope of scientific opinions and legal practices. In order the theme to be understood, the decisions of the Supreme Court have been stated in the study. The opinions in doctrine have been indicated for controversial points. Old and new provisions of the act have been compared when necessary. In the last part, the obtained results of the study have been summarized under the title of conclusion.
