Marka Hukukunda Mutlak Tescil Engelleri

Abstract

Marka, bir teşebbüsün mal veya hizmetlerini diğer teşebbüslerin mal veya hizmetlerinden ayırt etmek amacıyla kullanılan işaretlerdir. Bu işaretlerin marka olarak kullanılabilmesi için Türk Patent ve Marka Kurumu tarafından tescil edilmesi gerekmektedir. Türk Patent, kendisine gelen marka başvurusunda şekli bir eksiklik bulunmuyorsa markanın 6769 sayılı Sınai Mülkiyet Kanuna göre tesciline engel oluşturan bir neden olup olmadığını inceler. Marka olarak tescil edilmek istenen işaret, mutlak tescil engellerinden bir veya bir kaçını ihtiva ediyorsa başvuru, Türk Patent tarafından re'sen reddedilecektir. Mutlak tescil engelleri 6769 sayılı Sınai Mülkiyet Kanunu'nun 5. maddesinde düzenlenmiştir. Maddede sayılan tescil engelleri sınırlı sayıdadır. Kıyas yoluyla genişletilmesi mümkün değildir. Mutlak tescil engellerinin düzenlenme amacı; ayırt ediciliği olmayan, ticari hayatta herkesin kullanımına açık bırakılması gereken, mal veya hizmetlerin niteliği, kalitesi, coğrafi kaynağı konusunda halkı yanıltan, dini değer ve sembolleri içeren, kamu düzenine ve genel ahlaka aykırı işaretlerin tescil edilmesinin önüne geçmektir. SMK'da düzenlenen mutlak tescil engelleri, büyük ölçüde 556 sayılı mülga KHK ile aynı doğrultuda olmakla beraber, yenilenen AB mevzuatı doğrultusunda revize edilmiştir. Bu nedenle mutlak tescil engelleri mülga KHK ve AB mevzuatı göz önünde bulundurularak incelenmiştir.

Trademark are signs that are used in order to distinguish the goods or services of an enterprise from those of other enterprises. These signs must be registered by the Turkish Patent and Trademark Office in order to be used as a trademark. Turkish Patent examines whether there is any obstacle to the registration of the mark according to the Industrial Property Law No. 6769, provided that there is no lack in terms of shape. If the sign to be registered as a trademark contains one or more of the obstacles for absolute grounds for refusal, the application will be rejected by Turkish Patent. Absolute grounds for refusal are regulated in Article 5 of the Industrial Property Law No. 6769. There are only a limited number of registration barriers. Expansion by comparison is not possible. Purpose of regulation of absolute registration barriers is to prevent the registration of those signs which lack distinctive features, should be left open for everyone's use in commercial life, deceptive in terms of quality and origin of goods and services, containing religious values and symbols, and having offenses against public order and morality. While absolute registration barriers enacted by the IPL are in the same parallel with the Decree Law No. 556. to a great extent, they were revised in line with the renewed EU legislation. Therefore, the absolute registration barriers were examined with regard to the Decree Law no. 556 and the EU legislation.
