Osmanlı Devleti'nde Tabiiyet

Abstract

Osmanlı Devleti'ni 18. yüzyıldan itibaren uğraştıran tabiiyet sorunlarının sebeplerini, etkilerini ve sonuçlarını tespit etmeyi amaçlayan Osmanlı Devleti'nde Tabiiyet adlı tez çalışması Osmanlı arşiv belgelerine dayalı olarak hazırlanmıştır. Çalışma sürecinde tabiiyet sorunlarının sebepleri olarak kapitülasyonların sağladığı ayrıcalıklardan yararlanmak isteyen Osmanlı tebaasının yabancı devletlerin himayesine girmesi, 19. yüzyıldan itibaren başlayan devletlerarası göçler ve Osmanlı Devleti'nden ayrılarak kurulan devletlerin etkisi görülmüştür. Osmanlı Devleti, tabiiyet sorunlarını çözmek için bir takım tedbirler almıştır. İlk somut çözüm girişimi kendi tebaasından imtiyazlı tüccar zümresi oluşturmaktı. Bunu Osmanlıcılık politikası izlemiştir. Tebaanın kaynaşmasını hedefleyen Osmanlıcılık politikasını 1869 tarihli Osmanlı Tabiiyet Kanunu'nun yayınlanması izlemiştir.Tabiiyet Kanunu'yla, tabiiyet sorunlarının çözümünde seküler hukuk kurallarını temel kıstas kabul eden Osmanlı Devleti, Amerika, Rusya, Fransa, Yunanistan, Bulgaristan ve başka devletlerle yaşadığı sorunları çözmeye çalışmıştır. Bu devletlerin bazılarıyla anlaşma sağlanabilmiş bazılarıyla ise mutabakata varılamamıştır. Sonuçta bazı devletlerle çözülemeyen tabiiyet sorunları Cumhuriyet dönemine intikal etmiştir.The thesis study named Subjecthood in the Ottoman State, which aims to determine the reasons, effects and the results of the subjecthood problems in Ottoman State after the 18th century, is prepared according to the Ottoman archieve documents.During the study getting under protection of foreign states of Ottoman subject in order to get the privileges which the caputulations provide, international migrations after 19th century, States which were founded by leaving the Ottoman State were determined as the reasons for the subjecthood problems.Ottoman State took some measures in order to solve the subjecthood problems.The first concrete attempt of Ottoman State for solving this problem was to form a privileged merchant society among its own subject. Ottomanism policy followed this. Publishing of Ottoman Naturilization Law in 1869 followed the Ottomanism policy which aims the combination of the subject.Ottoman State, which accepted secular law as the main criteria for solving the subjecthood problems by publishing Naturilization Law ,tried to solve the problems with the USA, Russia, France, Greece, Bulgaria and other states. Ottoman State could agree with some of these states. But the problems with the other states continued up to the Republic Era.
