İslam Hukuk Tarihinde Taberî Mezhebi

Abstract

Bu doktora çalışmamızda; Hicri III. asırda yaşayan Muhammed b. Cerîr et-Taberî'nin (d.224/838 - ö.310/923) kurduğu ve yaklaşık iki asır kadar devam ettikten sonra kaybolan Taberî mezhebi ele alınmaktadır. Bu mezhep, Cerîriyye mezhebi olarak da bilinmektedir. Bu itibarla çalışmamızın asıl konusu, mezhebin İslam hukuk tarihi sürecindeki genel durumunu, kurucusunun hayatını ve ona tâbi olan fakihleri tanıtmak; mezhebin fıkhî hükümleri oluşturmada yararlandığı usûlü ve kendine özgü fıkhî hükümlerini ortaya çıkarmaktır. Taberî, tarihçiliğinin yanı sıra tefsir, hadis ve fıkıh ilmi başta olmak üzere İslâmî ilimlerin hemen tamamında yetkin bir âlimdir. Taberî, usûl ve furûuyla müstakil bir mezhep kurmuştur. O ve öğrencileri bu mezhebe dair eserler yazmışlardır. Ne var ki bu eserler günümüze kadar ulaşmamıştır. Bu sebeple Taberî mezhebine ait bilgiler daha çok meşhur tefsirinden elde edilmiştir. Taberî mezhebi esas olarak ehlisünnet çizgisini takip etmiştir. Bunun yanında özgün görüşleri de bulunmaktadır. In this thesis, a Tabri sect/denomation which emerged in 3rd Hijri century, established by Muhammad b. Jarir al-Tabari (b. 224/838 - d. 310/923) and which disappeared approximately two centuries later is discussed. This sect/denomation is also known as Cerîriyye sect. The main theme of my work is to study is the general condition of this sect/denomation in the history of Islamic law, the founder's life and to introduce those scholars who followed him; procedural advantage of this sect/denomation by creating their own Fiqh and to determine the peculiar provisions of Fiqh. Al-Tabari, is not only a historian but a competent scholar in commentary of Quran, Hadith and Jurisprudence, ıt ıs also the basics of Islamic sciences. Imam al-Tabari has established an independent denomination with Usul and Furû. He and his students have written a number of books regarding this sect/denomation. However, these books didn't reach until today. Therefore, the information relating to Al-Tabari's Sect/denomation was obtained from his famous commentary. Basically, Tabari sect/denomation was followed by Sunni school of thought. Besides this, original opinions have also been found. Key words: Muhammed b.
