El-Mebsût Bağlamında Serahsî'nin Aile Hukukuyla İlgili Hadislere Yaklaşımı

Abstract

'el-Mebsût Bağlamında Serahsî'nin Aile Hukukuyla İlgili Hadislere Yaklaşımı' adlı çalışmamız iki bölümden oluşmaktadır: Giriş kısmında çalışmanın önemi, amacı, yöntemi ve kaynakları hakkında bilgi verilmiştir. Birinci bölümde Serahsî'nin hayatı; adı, nesebi, tahsili, ilmî şahsiyeti, hapis hayatı ve hapsedilme sebepleri, hocaları, öğrencileri ve eserleri tanıtılarak mezhep içindeki yeri hakkında bilgi verilmiştir. İkinci bölümde ise, Serahsî'nin aile hukuku ile ilişkili hadisleri 'el-Mebsût' adlı eserinde hangi konular altında incelediği tespit edilerek konular başlıklara ayrılmış ve bu başlıklar altında hadisler incelerek Serahsî'nin bu hadislere yönelik değerlendirmeleri ortaya konmuş, ayrıca gerektikçe konuyla ilgili ayetlere de yer verilmiştir. Sonuç kısmında ise çalışmadan elde ettiğimiz neticeler ifade edilmiştir. Anahtar Sözcükler: İslam Hukuku, Aile Hukuku, Nikâh, Talâk, Nafaka

Our thesis consists of two parts. In introduction, information about the study's importance, purpose, method and resources are given. In the first part, Serahsî's life, ancestors, scholarship personage, personalities, imprisoment and the reasons' of imprisoment, teachers, students and his work are introduced, and information about his position in the sects are given. In the second part, Serahsî's Hadiths associated with Family Law. Within his work Mebsût on which topics that hadith's are assessed by Serahsî is included; topics are classified and within these subheadings. Serahsî's evaluation of these Hadisths is enlightened. Together with this, the ideas of some other erudite are also included. By the reason of being resources and in the first order in Islamic Law sources, verses, related to topics and explained detailed by our Prophet, is given. On account of its being on the front rant among Islamic Law Sources, some related verses that our Prophet had explained in detail, are also included.
