İslam Fıkhında Yemin

Abstract

Bu çalışma İslam fıkhında yemin konusunu ele almaktadır. Bu bağlamda yeminin lügat ve kavramsal çerçevesi, yakın kavramlarla ilişkisi, risalet öncesi ve sonrasında kullanım şekilleri ve gelişim süreci ortaya konulmaya çalışılmıştır. Çalışmanın esas bölümünde ise öncelikle Allah adına yapılan yeminler konusu olmak üzere, her biri ayrı birer başlık altında incelenen yemin ile ilgili İslâm fıkhındaki bütün konular, hayattaki kullanım alanlarıyla beraber bir bütün halinde sunulmuşturThis study addresses the issue of oath-making in Islamic Law.In this regard, we tried to present lexical and conceptual framework of oath-making, its relation with similar concepts, semantical analysis of the concept as it is used in the preprophecy and the post-prophecy periods, and its (historical and semantic) evolution. As for the basic part of the study, the paper presented all the issues related to oathmaking in Islamic Law, particularly the oaths taken in the name of Allah, by examining each one under a seperated topic with the usage areas of the concept in life as a whole
