Türk Vergi Hukukunda Hata ve Düzeltme

Abstract

Vergi hatası, vergi ile ilgili hesaplarda ya da vergilendirmede yapılan hatalar nedeniyle haksız yere fazla ya da eksik vergi istenmesi ya da alınmasıdır. Vergi hatalarından kaynaklanan uyuşmazlıkların idari ve yargısal aşamada çözümlenmesi mümkündür. Vergi hataları ve bu hataların düzeltilmesi, tezin konusunu oluşturmaktadır. Bu tezin amacı, vergi hataları ve bu hataların düzeltilmesi için öngörülmüş olan çözüm yollarının, Türk Vergi Hukukundaki yerinin ortaya konulmasıdır. Tezde yargı kararlarından ve doktrindeki görüşlerden faydalanılarak uygulamada karşılaşılan sorunlara çözüm aranmaktadır. Bu itibarla vergi hatalarının düzeltilmesi için öngörülmüş olan çözüm yollarının işlevselliğini etkileyen sorunların tespiti ve ortadan kaldırılmasına yönelik katkı sunulması hedeflenmektedir.

A tax error is an unfair request or receipt of more or less tax due to errors made in tax-related calculations or taxation. It is possible to resolve disputes arising from tax errors at the administrative and judicial stages. Tax errors and correction of these errors constitute the subject of the thesis. The aim of this thesis is to reveal the place of tax errors and the solutions provided for the correction of these errors in Turkish Tax Law. In the thesis, solutions are sought to the problems encountered in practice by making use of judicial decisions and opinions in doctrine. In this respect, it is aimed to contribute to the detection and elimination of problems that affect the functionality of the solutions provided for the correction of tax errors.
