Abstract
Kamu personel yönetiminin amacı, kamu kesiminin bütün birimlerine, devletin amaçlarını gerçekleştirecek sayıda ve yeterlikte personel bulmak, yetiştirmek ve kamuoyunun istediği ve beklediği hizmetleri nitelikli bir şekilde sunmaktır. Kamu personel yönetiminin bu amaçlarını gerçekleştirebilmesi için liyakat ilkesi kilit rol oynamaktadır. Bu amaçların gerçekleşmesi için liyakat ilkesinin benimsenmesi ve uygulanması gerekmektedir. Rasyonel bir biçimde işleyen bir bürokrasinin varlığı için liyakat ilkesinin tavizsiz bir şekilde uygulanması son derece önemlidir. Bu açıdan liyakat ilkesinin varlığı kadar uygulamadaki yeri de çok önemlidir. Çalışmanın birinci bölümünde kamu personeli, kamu istihdamı ve kamu personel rejimi ile ilgili teorik çerçeve çizilmiştir. Çalışmanın ikinci bölümünde, liyakat ilkesi ile ilgili kavramsal çerçeve ve ilkenin tarihi gelişimi üzerinde durulmuştur. Bu bölümde ayrıca, liyakat ilkesinin Almanya, Fransa, İngiltere ve Amerika Birleşik Devletleri (ABD)'ndeki durumu analiz edilmiştir. Üçüncü bölümde ise ABD'de var olan Liyakat Sistemi Koruma Kurulu'nun yapısı ve işlevleri analiz edilerek Türkiye'de böyle bir kurulun kurulması için bir öneri sunulmuştur. Bu çalışmada liyakat ilkesinin kamu personel rejimi ve Türkiye için önemi vurgulanarak, liyakat ilkesinin mevzuatta yer aldığı kadar uygulamada da var olabilmesi için Liyakat İlkesini Koruma Kurulu adı altında bir kurul önerilmiştir. Önerilen kurulun yapısı, işlevleri ve faydası üzerinde durulmuştur.
The aim of public personnel management is to find, train and provide qualified and qualified personnel in all departments of the public sector. The principle of merit plays a key role for public personnel management to achieve these objectives. In order to achieve these objectives, the principle of merit should be adopted and implemented. For the existence of a rationally functioning bureaucracy, it is very important to implement the principle of merit uncompromisingly. In this respect, the place of merit as well as the existence of the principle of merit is very important. In the first part of the study, the theoretical framework related to public personnel, public employment and public personnel regime was drawn. In the second part of the study, the conceptual framework related to the principle of merit and the historical development of the principle are emphasized. In this section, the situation of the merit principle in Germany, France, England and the United States is analyzed. In the third section, which had in the US Merit Systems Protection Board analyzed the structure and function of a model proposal for the establishment of such a committee it has been presented in Turkey. In this study merit of public personnel regime and emphasized the importance for Turkey, Merit Policy has to be included in the legislation in practice as a committee of the merit principle has been proposed under the name Preservation Board. The structure, functions and benefits of the proposed board are emphasized.
