1764 10 No'lu Samsun Şer'iyye Sicil Defterinin (Vr.1a-30b) Transkripsiyonu ve Değerlendirilmesi

Abstract

Bu çalışmayla 19. yüzyılın son döneminde Samsun bölgesinin dîni, sosyal, ekonomik ve kültürel açıdan durumunun tespitine katkıda bulunmayı hedefledik. Samsun'la ilgili kırk üç adet şer'iyye sicil defteri bulunmaktadır. Bu defterlerden şuana kadar tespit edebildiğimiz on altı tanesi ile ilgili çalışma yapılmıştır. Yaptığımız bu çalışmayla hem Samsun'un tarihine katkıda bulunduk hem de bu şer'iyye sicillerinden birini transkribe ederek ilim dünyasına kazândırdık. Çalışma 1764/10 numaralı ve 1857-1863 tarihlerini içeren Samsun şer'i mahkemesine ait şer'iyye sicil defterinin (vr.1a-30b) tahlilidir. Tez giriş hariç iki bölümden oluşmaktadır. Giriş kısmında, araştırmanın problem ve önemi, veri toplama araçları, araştırmanın sınırlılıkları ile kullanılan yöntemler hakkında bilgi verilmiştir. Birinci bölümde şer'iyye sicillerinin tanımı ve Samsun mahkemelerinde tutulan şer'iyye sicil defterleri ve bunlar üzerinde günümüze kadar yapılan çalışmalar belirtildikten sonra, 1764/10 numaralı Samsun şer'iyye sicil defterinde geçen kayıtlardan yola çıkarak, Samsun'un 19. yüzyıl sonlarındaki sosyal, kültürel, ekonomik ve idari yönlerden değerlendirmesi yapılmıştır. Çalışmanın ikinci bölümünde orjinal metnin latin harflerine transkripsiyonu yapılmıştır. Transkripsiyon yapılırken kayıt başlarında içerikle ilgili kısa bir başlık konulmuş ve kayıtlar numaralandırılmıştır. Sonuç kısmında incelediğimiz şer'iyye sicil defterinden çıkarılan sonuçlar kısaca belirtilmiştir. İncelediğimiz 1764/10 numaralı defterde (vr.1a-30b) 248 adet kayıt bulunmaktadır. Kayıtlar vekil, kefil, vasi ve nafaka tayini, alacak verecek davası, arsa, tarla ev ve hisse satışı, tereke taksimi, kamu görevlisi tayini, çalınmış veya kaybolmuş mallarla ilgili hükümlerden oluşmaktadır. Çalışma 1857-1863 yıllarında Samsun şer'i mahkemesine intikal eden olayları kapsamaktadır. Buradan elde edilen sonuçları toplumun tamamına genellememiz ve buradan genele ilişkin bir hükme ulaşmamız doğru bir yaklaşım olmamaktadır. In this study, we aimed to make a contribution to the determination of the religious, social, economical and cultural situation in Samsun region at the end of the 19th century. There are 43 religious law documents related to Samsun. There have been 16 studies detected so far on these documents, however there have not been any studies on the others, yet. With the help of this study, we not only contributed to the history of Samsun but also transcribed the law documents to the field. The research includes the Religious Law Documents of Samsun from the period 1857-1863 and the documents numbering 1764/10(vr.1a-30b). The thesis includes two sections, aside from the introduction. In the introduction part, research problems, significance of the research, limitations of the study and research methodology are presented. In the first section of the study, the definition of Religious Law Documents and the Religious Law Documents which were recorded in Samsun up to now are mentioned, regarding the registers done on the Religious Law Documents of number 1764/10, a detailed evaluation of Samsun's social, cultural, economic and administrative situation at the end of the 19th century is presented. In the second section of the study, the original documents have been transcribed into the Latin alphabet. Within the transcription, a short summary of the context is given at the beginning of each register. In the conclusion chapter the results, concluded from the registers are listed. There are 248 registers in the documents numbered 1764/10(vr.1a-30b). The registers are composed of terms on attorney, surety, tutor, alimony, owings and receivables case, land field, home and sale of shares, winding of estate, assigning public officials, stolen or lost goods. The study includes records documents kept in law courts in Samsun between the dates 1857-1863. Thus, results gathered from the study cannot be generalized to all the people living at that time, as it would not be a right approach to reach a judgement related to general.
