Abstract

Özel hukukun önemli konularından biri olan şahsa sıkı sıkıya bağlı haklar kapsamında hukuk sistemimizdeki tek yasal düzenleme, 4721 sayılı TMK m.16/I'dir. Bu fıkrada ilgili kavrama yönelik herhangi bir tanımlamaya yer verilmemiş; yalnızca sınırlı ehliyetsizlerin bu hakları kullanmada yasal temsilcilerinin rızasına bağlı olmadıkları hususu düzenlenmiştir. Çalışmanın konusunu oluşturan şahsa sıkı sıkıya bağlı haklara ilişkin kanuni düzenlemedeki yetersizlik ve hangi hakların bu kapsamda olduğu konusundaki belirsizlik sebebiyle, gerçek kişilerin fiil ehliyetlerine göre bu hakların kullanımının ne şekilde gerçekleşeceği noktasında görüş ayrılıkları doğmuştur. Bununla birlikte, şahsa sıkı sıkıya bağlı hakların kullanılmasına yönelik Türk hukukundaki incelemelerin yetersiz sayıda olması ve bunların sonucu olarak da uygulamada bu hakların kullanılmasına ilişkin farklı nitelikteki yargı kararları, Çalışmada bu konunun incelenmesini, kavramın tanımının, esaslarının ve kullanımının belirlenerek mevcut ihtilaflara çözümcül ve pratikte fayda sağlayan bir bakış açısı kazandırılması amaçlanmıştır. Bu amaca yönelik olarak, öncelikle yasal bir tanımı yapılmamış olan şahsa sıkı sıkıya bağlı hakların öğretide yapılan tanımlamalarına yer verilmiş, ardından bu hakların benzer nitelikteki diğer hak grupları ile farkları, hakkın ihtiva ettiği özelliklere ilişkin istisnalar, sınırlı ehliyetsizler dışındaki ehliyet gruplarının şahsa sıkı sıkıya bağlı hakları kullanmaları noktasındaki özellikler, tüzel kişilerin ilgili haklara sahip olma ehliyeti ve hangi şahsa sıkı sıkıya bağlı hakları ne şekilde kullanabilecekleri konuları açıklığa kavuşturulmaya çalışılmıştır. Şahsa sıkı sıkıya bağlı hak kavramına ilişkin olarak ortaya konulan tüm esasların ardından, ilgili kavramın bir özel hukuk kavramı olması sebebiyle öncelikli olarak özel hukuk ve bilhassa Medeni Hukuk alanındaki her bir şahsa sıkı sıkıya bağlı ayrı konu başlığı şeklinde incelenmiştir. İncelenen haklara ilişkin varsa tartışmalara ve görüş ayrılıklarına yer verilerek bir kanaate ulaşılması hedeflenmiş, hakkın ihtiva ettiği özellikler, hukuki mahiyeti, farklı ehliyet gruplarının ilgili şahsa sıkı sıkıya bağlı hakkı ne şekilde kullanabileceğine yönelik belirlemelere, her bir şahsa sıkı sıkıya bağlı hak açısından ayrıca temas edilmiş ve şahsa sıkı sıkıya bağlı hakların kullanılmasına ilişkin esaslar belirlenmeye çalışılmıştır.

The only legal regulation in our legal system within the scope of strictly personal rights, which is one of the important subjects of private law, is Article 16/I of the TMK No. 4721. This paragraph does not include any definition of the related concept; it is regulated that only limited incompetent persons do not depend on the consent of their legal representatives in exercising these rights. Due to the inadequacy of the legal regulation regarding the rights that are closely tied to the individual, which is the subject of the study, and the uncertainty about which rights are within this scope, there have been differences of opinion on how these rights will be exercised according to the capacity to act of real persons. However, the insufficient number of examinations in Turkish law regarding the use of personal rights and, as a result of these, different judicial decisions regarding the use of these rights in practice, the examination of this issue in the study, the definition, principles and use of the concept, which provides a solution to existing conflicts and provides practical benefits. intended to provide perspective. For this purpose, first of all, the definitions of strictly personal rights, which have not been legally defined, are included in the doctrine, then the differences of these rights with other right groups of similar nature, exceptions regarding the features of the right, the strictly personal rights of the competence groups except for the limited incapacities. It has been tried to clarify the features of the legal persons to use the rights, the capacity of legal persons to have the relevant rights and how they can use the rights that are closely tied to which person. After all the principles set forth regarding the concept of right tied to the individual, since the related concept is a concept of private law, it has been examined primarily as a separate topic that is closely tied to each individual in the field of private law and especially Civil Law. It was aimed to reach an opinion by including discussions and differences of opinion regarding the rights examined, the characteristics of the right, its legal nature, determinations of how different groups of competence can use the right that is closely tied to the person concerned, and the right closely tied to each individual was discussed separately. It has been tried to determine the principles regarding the use of personal rights.
