Türkiye'de Yerel Yönetimlerde Özerklik ve İdari Vesayet

Abstract

Günümüz dünyasında her alanda var olan hızlı değişim ülke yönetimlerine de yansımış ve bunun sonucu olarak ülkeler yeni yönetim modellerine kapı aralamaya başlamıştır. Yerelleşme yeni yönetim modellerinin en demokratik olanı olarak düşünüldüğünde, taleplerinin artması ile bağlı olarak halkın yönetimde söz sahibi olma isteği gün geçtikçe pratiğe dökülmektedir. Kendini yenileyememiş, merkeziyetçi, otoriter yönetim modeli yerini demokratik, güçlü yerel yönetimlere bırakmaktadır. Bu çalışmamızda yerel yönetimlerde özerklik kavramının ülkemizdeki anlayışı, tarihsel süreci ve dayandığı temel esaslara değinilmiştir. Yerel yönetim kavram tanımlamaları yapılarak, yönetim türlerinde bahsedilmiştir. Temel çalışma konumuz Türkiye olması nedeniyle yerel yönetimlere bakışın Osmanlı döneminden, ilk Cumhuriyet dönemi ve son dönemlere kadar geçirdiği evrelere yer verilmiştir. Günümüzde yerel yönetim anlayışının tekrar gözden geçirileceği ve yeniden düzenleneceği konusunda merkezi otoritenin yazılı beyanları olmuş olsa da, Türkiye'de yerel yönetimler temel kurumları İl Özel İdaresi, Belediyeler, Büyükşehir Belediyeleri ve Köylerdir. Yerel özerklikten kastın, devlet bütünlüğünü temelden sarsan 'özerklik' kavramı olmadığına ve detaylı tanımına çalışmamızın ikinci bölümünde yer verilmiştir. Türkiye'de yerel özerkliğin temel yasal dayanakları açıklanmış ve Avrupa Yerel Yönetimler Özerklik Şartı detaylandırılmıştır. İdari vesayet, merkezi yönetim ile yerel yönetim kuruluşları arasında ki bir yönetim ilişkisidir. Vesayet denetimi idarenin bütünlüğü ilkesinin bir gereği olarak yasaların öngördüğü sınırlar içerisinde, yerel yönetimlerin merkezi idare tarafından denetlenmesi olarak tanımlayabiliriz. Bu çalışmamızda idari vesayet denetimine detaylı bir biçimde yer verilmiş, türleri, şartları ve kapsamı anlatılmaya çalışılmıştır. Türkiye'de yapılan yeni reformlarla yerel yönetimlerde özerkliğin her geçen gün daha demokratik seviyelere çıktığı görmekteyiz. Tüm eksiklik ve aksaklıklara rağmen bu yönde atılan adımların, hem değişen toplum yönetimi anlayışında halkın isteklerinin karşılanması açısından hem de yeni ve daha demokratik reformlara kapı aralaması bakımından önemli bulunmaktadır.

The rapid change seen in every field in today's world is also could be witnessed in the state administration and as a result of this, the states began to give green light to these new administration models. It is an inevitable fact that the new administration models which are more transparent care about the public's demand and opinions as well as lead to a more democratic direction This work touches on the Turkey's understanding of the autonomy in the local authorities, its history as well as the basic principles of it. The local authority is referred within the administration types by definingthe related concepts. Due to the fact that Turkey is our main study topic here, how the look towards the local authorities has evolved since the Ottoman Empire until the first Republic era and the current period is included. Although we see the written declarations of the central authority claiming to review and rearrange the local authorities, the basic local institutions in Turkey are the provincial special administration, municipalities, metropolitan municipalities and villages. The second part of this paper explains that the local autonomy is not the 'autonomy' which shakes the foundations of the state integrity and explores its detailed definition. The fundamental and legal foundations of the local autonomy in Turkey are clarified and 'European Local Authorities Autonomy Condition' is elaborated. The administrative tutelage is an administration relationship between the central authority and local authority institutions. The tutelage supervision could be defined as thecontrolof the local authorities by the central administration within the limits foreseen by the legislationas a condition of the administration integrity principle. Through providing light on its types, conditions and extent, our study analyses the administrative tutelage in detail. We observe that the autonomy becomes more democratic in the local authorities day by day thanks to the current conducted reforms in Turkey. The steps taken,despite all of the deficiencies and troubles, in this regard considered significant in terms of both addressing the public demand for the changing society administration as well as welcoming the new and more democratic reforms.
